2.    I have dealt extensively with my reasons for judgment  and do not intent repeating it once more.

3.    I am of the opinion that no other court will come to a different decision.

1. The application for leave to appeal is dismissed;

2. The applicant to pay the costs, including the costs of senior counsel.
