Having read the documents and having considered the matter:



IT IS ORDERED THAT:



  1. The application for condonation is granted.

  2. The application for rescission is granted with costs again the representatives of the Respondent and on an attorney own client scale de bonis propriis.


  1. The costs incurred in respect of the urgent application must be paid by the Respondent’s attorneys on an attorney and client scale de bonis propriis.


  1. The matter is referred to the law society to investigate the conduct of the Respondent’s legal representation.
