APPLIACTION FOR LEAVE TO APPEAL

[1] This is an application for leave to appeal against a judgment handed down by this Court on 1 December 2015.

[2] I have considered the grounds of appeal and the submissions in support thereof. In light of the conflicting decisions in point, I  am of the view that there are reasonable prospect of success on appeal.

[3] In the event the following order is made:

3.1         The application for leave to appeal is granted.

3.2         Costs of the application for leave to appeal shall be costs in the appeal.
