JUDGMENT

(Application for Leave to Appeal)




ALLIE, J



In this matter, having considered the argument, and having looked at the judgment and reasons for judgment again, I am of the view that there is a reasonable prospect that another Court may come to a different decision in respect of the convictions for ACCUSED 1. 2. 4 AND 6. particularly in the light of the finding of common purpose, namely, that the accused acted in concert and those convictions were primarily in relation to counts 1 to 5. I am accordingly prepared to GRANT LEAVE TO APPEAL TO THE FULL BENCH OF THIS DIVISION based on the lack of evidence of the State witnesses



I am granting TO ACCUSED 4 AND 6 LEAVE TO APPEAL AGAINST THEIR SENTENCES TO THE FULL BENCH OF THIS DIVISION



In relation to the application made on behalf of accused 8 for leave to appeal against the sentence of three years direct imprisonment I am of the opinion that there is no reasonable prospect of another Court coming to a different conclusion and so LEAVE TO APPEAL AGAINST THE SENTENCE IN RESPECT OF ACCUSED 8 IS THEN REFUSED.
