This matter will be postponed to 15 March 2011 for further hearing. The defendant will bear all the wasted costs occasioned by the postponement and occasioned by the delays over the last few days as a result of the defendant being unable to call any witness. Those costs will be costs on the attorney and client scale.



And before this matter resumes on the 15th, I want filed an affidavit by the witness, Mr Hannes Swart, explaining exactly why he was unable to testify in this court on 18, 21, 22, 23 and 24 February 2011 in this matter, exactly why he was not available to testify on any of those days. The costs will include 21 and 22 February as well.
