JUDGMENT

 

CAMBANIS AJ:

[1] This is an application for leave to appeal the judgment of this matter handed down on 22nd September 2017.

[2] Both parties furnished this court with written heads of argument containing detailed analysis of the judgment.  I am indeed indebted to both counsel for their thoughtful assistance in this regard.  In addition, counsel tendered lengthy oral argument in amplification of their heads of argument.

[3] I have taken all the above into consideration and have carefully considered the arguments and I accordingly make the following order:-

1. The petition for leave to appeal is dismissed with costs on an attorney client scale.
